Novelli asked to stop access to the expert opinion that revealed data about the agreement between Milei and Davis

The expert examination of the content of the devices seized from Mauricio Novelli and Sergio Morales, two of the defendants in the $Libra case, sparked a dispute between the plaintiff and the defense within the framework of the file for alleged fraud and other crimes. The thing is that until now only a general report was known about that content and it was learned that in the annexes that are reserved there would be information about the confidential agreement that was apparently signed by the president Javier Milei and the token developer Hayden Davis. Faced with this, one of the defense lawyers asked that the information be kept secret until it was analyzed, while the affected individuals presented their requests to access the material.

The dispute between the complaint and the defense arose after the Prosecutor’s Office incorporated into the file a summary of the analysis carried out by the Directorate of Technological Support for Criminal Investigation (Datip). That report analyzed the content of the cell phones and other devices seized from Novelli and Morales based on a series of parameters set by prosecutor Eduardo Taiano and supported by judge Marcelo Martínez De Giorgi. Among other things, it was ordered to look for possible exchanges with the president, his sister Karina Milei and other defendants in the case.

In one of the points it had been made clear that the search for information had to exclude any conversation or contact that Novelli and Morales may have had with their defense attorneys. It had also been made clear that the search parameters were strictly aimed at the procedural object of the case.

Even so, for Novelli’s defense, the information collected by Datip and that is in the possession of the Prosecutor’s Office in reserved annexes that the parties have not yet been able to see must remain confidential. Through a letter accessed by Tiempo, defense attorney Daniel Ruvinovich asked that this remain the case until its relevance and “balance with the rights of the people involved” are resolved.

The defense claims that before the aforementioned annexes are uploaded to the judicial file, there is a judicial control of “relevance, proportionality and necessity.” This is to determine which documents or records should be incorporated because they are linked to the object of the investigation and which should remain outside the file because they are not.

The objective of the request is “to avoid unjustified interference in the privacy of my client and third parties.” The defender also pointed out that there is a risk that “people’s private lives will be exposed in an undue and unjustified manner.”

For Rubinovich, “it cannot be ignored that the public interest surrounding these actions increases the risk that information completely irrelevant to the procedural object will be replicated outside the file.” From the general report that has emerged so far and that the parties were able to see, for the defense, “the existence of a large amount of information that lacks any link with the proceedings” emerges.

Define Taiano

On the front sidewalk, the complainants want access to the material. Mainly because for the first time elements related to the confidential agreement that Milei and Hayden Davis, developer of the token promoted by the president on February 14 of last year, would have emerged in the case.

It is worth remembering that the president is the main accused but not the only one. Justice is investigating an alleged scam around the token that, after the presidential diffusion, saw a jump in value from cents on the dollar to around US$5, only to collapse after a few minutes. In that period there was a trend of investors with large losses.

Faced with the request of the complaints to access the material that until now remains reserved and the intentions of Novelli’s defense that it continue like this at least until it is reviewed and only the information relevant to the case is made known, now the ball is in the hands of the prosecutor.

According to the general report prepared by Datip, exchanges were found on the devices prior to the launch of $Libra between Novelli and the Milei brothers. It was learned of the existence of several messages that were deleted and even a control board on which the token appears. According to what Tiempo was able to know, Taiano has to evaluate all the proposals and define what position he will take regarding that information and the possibility of it being uploaded to the file.
